Two Binghamton University students were arrested by Binghamton Police and charged with felonies Saturday at 2:30 a.m. after a fight with police broke out at Uncle Tony’s bar on State Street.

Police said Edward Rabinovich, 21, attacked an officer while that officer was trying to break up a fight in the bar, reported the Press and Sun-Bulletin. Robert Simonoff, 20, was accused of punching a bar employee during the skirmish.

According to officials, Rabinovich, of Washington Street, was charged with two counts of second-degree assault on a police officer, a felony, and one count of resisting arrest, a misdemeanor. His housemate, Simonoff, was charged with third-degree assault, a misdemeanor, and criminal possession of a forged instrument, also a felony.

Both students were arraigned Saturday morning and sent to Broome County Jail on no bail. They were released Monday on their own recognizance.

When asked if the two students had been suspended from school, BU spokesman Ryan Yarosh said, ‘We are currently reviewing the police reports to determine further action.’

Four other male housemates of the Washington Street residence were at the bar the night of the arrests. All but one wished to remain anonymous.

According to the third housemate, a male officer in a dark blue jacket was pushing his way toward him.

‘I didn’t know he was an officer at that point,’ the third housemate said. ‘I thought he was a drunk guy hitting people.’

The officer shoved the third housemate into the bar and into other people, the third housemate said.

‘What’s going on?’ he asked the officer. ‘Why’d you push me?’

But according to the third housemate, the officer started yelling at him, accusing the the third housemate of hitting him even though he said he had not. The third housemate, who said he had not seen the officer identify himself as police, then realized he was dealing with an officer after he noticed a police patch on the shoulder of the overcoat.

A fourth housemate stepped in to separate the fight.

At that point, ‘All hell broke loose,’ the fourth housemate said. ‘People started yelling. A wave of people was pushed back.’

The fourth housemate lost sight of the scuffle after getting caught up in the crowd, but about 10 seconds later he saw an officer calling for back-up on a radio.

Craig Aquino, Simonoff’s roommate, was smoking a cigarette outside the back entrance of the bar when people started running out.

‘Someone ran outside and told me, ‘Your boys are getting their asses kicked inside,’ Aquino said.

Aquino said he went into the bar to see officers take Simonoff away in handcuffs and Rabinovich on the ground getting kicked by at least three officers. Rabinovich’s face was bruised and his shirt was ripped, Aquino said.

Aquino then saw a fifth housemate on the outskirts of a crowd, holding his arms up to hold people back, Aquino said.

‘Out of nowhere a cop approached him. He put his hands up in a surrendering way as if to say don’t hit me,’ Aquino said. ‘He showed open palms.’

Aquino said he saw an officer strike the fifth housemate in the face with a nightstick. Another officer came over and, with both hands, grabbed the fifth housemate by the throat and threw him to the ground, Aquino said.

The fifth housemate was also arrested, but was released the same day. According to Aquino, the fifth housemate went to the hospital because he thought he had a concussion.

A CAT scan revealed that the bone surrounding his eye socket was broken.
