The investigation into a rape complaint which named a Binghamton University student as the perpetrator has been closed, according to police.

Binghamton City Police Capt. Alex Minor confirmed Thursday that there will be no arrests or charges made in connection with the complaint, which was filed last week. There will be no further investigation.

He also confirmed that both the person named in the complaint and the person who filed it were BU students, but declined to release their identities.

“This is one of the situations where it was kind of he-said, she-said,” he said. “There were some other questionable circumstances.”

Both the alleged victim and perpetrator, along with witnesses, were interviewed by Minor’s agency. Minor then conferred with Broome County District Attorney Gerald F. Mollen, who decided against any type of prosecution.

“After going over the totality of the incident, the DA decided justice would be best served if there were no charges,” Minor said, adding that everybody involved in the case had been notified of the decision.

The complaint was filed Wednesday, Aug. 27, shortly after 1 a.m., and named 23 Henry St., a multi-home apartment building in Downtown Binghamton, as the location.

The building houses members of the social fraternity Pi Lambda Phi, who held a social event the night the complaint was filed.

Minor confirmed that alcohol was involved. He also said that to his understanding, the alleged perpetrator was not a member of the fraternity.

“It had nothing to do with a brother in the fraternity. It had to do with an outsider that came to the house that night,” Matt Katz, Pi Lambda Phi president, told Pipe Dream on Monday.

According to Katz, neither he nor his fraternity members were aware of anything happening at the time, and they were cooperative with police.
